This is part 1 of a multipart series of articles regarding offered anti-gambling legislation. In this article I discuss the offered legislation, what the people in politics say สล็อต it does, some a description of the current state of online betting, and what the bills really propose.
The legislators attempt to protect us from something, or are they? The whole lot seems a little confusing to say the least.
The house, and the Senate, are once again considering the issue of “Online Gambling”. Bills have been submitted by Congressmen Goodlatte and Leach, and also by Senator Kyl.
The bill being put forward by Rap. Goodlatte has the stated plan of updating the Line Act to outlaw all forms of online betting, to make it illegal for a betting business to receive credit and electronic moves, and to force ISPs and Common Carriers to block access to betting related sites at the request of law enforcement.
Just as does Rap. Goodlatte, Sen. Kyl, in his bill, Prohibition on Funding of Against the law Internet Betting, makes it illegal for betting businesses to receive credit cards, electronic moves, checks and other forms of payment, but his bill does not address the keeping of wagers.
The bill submitted by Rap. Leach, The Against the law Internet Betting Enforcement Act, is really a copy of the bill submitted by Sen. Kyl. It focuses on preventing betting businesses from accepting credit cards, electronic moves, checks, and other payments, and like the Kyl bill makes no changes as to what is currently legal.
According to Rap. Goodlatte “While betting is currently illegal in the united states unless regulated by the states, the development of the Internet has made betting readily available. Very for illegal betting businesses to operate freely until law enforcement finds and stops them. inches
In fact, American courts have determined that the Line Act makes only Sports Wagering illegal, and even then only across telephone lines. Very few states have laws that produce online betting illegal, some states and Tribes have taken steps to legalize online betting, and even the government identifies some forms of online betting as being legal.
Goodlatte himself says his bill “cracks down on illegal betting by updating the Line Act to cover all forms of interstate betting and take into account new technologies. Under current federal law, it is unclear whether creating an online business to operate a betting business is illegal”.
Goodlatte’s bill however does not “cover all forms of interstate gambling” as he claims, but instead carves out exemptions for several forms of online betting such as state lotteries, wagers on horse racing, and fantasy sports. Even then, his modifications to the Line Act do not make online betting illegal, they make it illegal for a betting business to receive online wagers where a person risks something of value “upon the end result of a tournament of others, a sporting event, or a game mostly controlled by chance”, except of course if it is circumstances lottery, horse race, fantasy sports, or one of added situations.
The truth of the matter is that most online betting businesses have located in other countries specifically to avoid the grey area that is the current state of online betting in the usa. As a result, there is little that law enforcement can do to put in force these laws. Trying to make the laws tougher, and providing for more rigid penalties, will not make them simpler to put in force.
As well, most, if not all, banks and creditors refuse to transfer money to an online betting business now, as a result of pressure from the government. As a result, alternative payment systems sprang up to fill the void.
Senator Kyl is equally deceptive in his statements. From his offered bill, “Internet betting is primarily funded through personal use of payment system instruments, credit cards, and line moves. inches But even as already know, most credit cards in the You. S. reject attempts to invest in a betting account.
Also from the Kyl bill, “Internet betting is a growing cause of commercial collection agency problems for insured depository institutions and the credit rating industry. inches If the creditors and other financial institutions in the You. S are not allowing the funding of betting, how would it be “a growing cause of commercial collection agency problems”. And since when do we’d like legislation in order for the financial industry to protect itself from risky debt. If the financial industry was accepting betting debts and these betting charges were a problem for them, wouldn’t they just stop accepting them?
Like Rap. Gooddlatte, Rap. Leach and Senator Kyl carve out exemptions for wagering on horse racing, for fantasy sports and for buying and selling sec. Unlike Rap. Goodlatte however, Rap. Leach and Sen. Kyl do not exempt state lotteries from their prohibition of online betting.
